TERMS & CONDITIONS
§ 1 General
Christian Karch Atelier1951, Guenthersburgallee 53, 60316 Frankfurt am Main, info@atelier1951.com (hereinafter "Atelier" or "we"), operates an online store at https://atelier1951.com and at https://atelier1951.de (the "Website"). All orders placed by you via the Website as well as our deliveries and services are governed exclusively by the General Terms and Conditions of Business set out below, as applicable at the time the order is placed. We do not accept any diverging terms and conditions from the customer except where specifically agreed in writing.
The European Commission provides a platform for the out-of-court resolution of disputes (ODR platform), which can be viewed under https://ec.europa.eu/odr.
We are not willing to enter into dispute resolution proceedings before the consumer arbitration board.
§ 2 Contracts
1. The languages available for contracts are German and English.
2. The presentation of products on our Website does not constitute any offer by Atelier for a purchase contract.
3. By submitting the order form provided on our Website, you are placing a binding offer for a purchase contract with us. Before submitting your offer you will be able to view the details and correct any mistakes in the information provided.
4. On receipt of your order we will send you an order confirmation. Please note that our order confirmation does not constitute a declaration of acceptance of your contractual offer but serves for information purposes only.
5. A purchase contract between you and Atelier will become effective only after we have accepted the offer by dispatching the goods ordered. The goods will be dispatched only after the full amount has been credited to our account.
6. Atelier has the right to refuse any offer without stating a reason.
§ 3 Cancellation policy advisory
The cancellation policy applies solely to consumers under § 13 of the German Civil Code of Law.
CANCELLATION POLICY
You may repeal your contract of purchase within 30 days without having to state reasons.
The allocated cancellation time frame is 30 days, effective the day that you or an assigned third party, who may not be the carrier/courier took said commodities into their possession.
To administer your right to cancel your order, you have to inform us, Christian Karch Atelier, Guenthersburgallee 53, 60316 Frankfurt am Main, by e-Mail: info@atelier1951.com or by sending us an explicit declaration stating that you are repealing your contract of purchase (for example: by sending us a letter in the mail, or an e-mail).
It will suffice to send us your notification of repeal within the given cancellation time frame in order for the 30-day cancellation time frame to be granted.
CONSEQUENCES
If you repeal your contract of purchase, we are obligated to refund all payments that we have received from you immediately and within 30 days at most, effective the day that we receive your repeal.
The payment method which was used to make the transaction will also be used for the reimbursement, unless we have explicitly agreed to something else. You will not be charged any fees for the reimbursement.
We reserve the right to withhold the reimbursement until we have received the returned items.
The items have to be sent back to us immediately after you have notified us of the cancellation of this contract. All return shipments are at buyer's expense.
You are only required to compensate us for any loss in value if the loss in value can be traced back to unnecessary handling, which goes beyond the admissible proofing of the condition of the item, its characteristics and functionality.

§ 4 Make-To-Order/ Customized Products
1. A product ordered on the 'website' that has been personalized or specifically made for a customer cannot be returned for exchange or refund. Given the bespoke nature of the service, payment will be taken in full at the time the order is placed.
2. The shipment of products made from exotic skins is subject to jurisdictional laws; as the customer you are responsible for ensuring that the requested exotic material can be shipped to your respective region/address. § 5 Return shipments
If you are not 100% satisfied with your purchase from Atelier1951, we will offer a full refund.
Once we have received the return shipment, we will confirm receipt. All approved returns will be credited soonest, but in any event not later than 30 days from the day on which we have received your decision to withdraw from this contract.
§ 5.1 Return Conditions
All items must be returned in their original condition, without having been worn or altered, and with tags still attached
Merchandise must be returned in one package
We can only accept returns from the country to which an order was originally shipped.
§ 5.2 Refunding the Purchase
Once the return has been checked by our team, you will receive an E-Mail regarding the returned items. We will refund you as quickly as possible. Please note:
Your refund will be issued according to the payment method you have chosen at the time of ordering.
Your refund is always credited in the same currency as the original purchase to the purchaser's account
Shipping costs are not refunded. For orders that originally were dispatched to a destination within the EU your refund will include sales tax.
For orders that were shipped outside the EU we cannot refund customs-duties and local sales tax. You may want to negotiate directly with your local customs office.
The time it takes to receive your refund depends on the original payment method.
Customized items cannot be returned.

§ 6 Price; product presentation; availability
1. The price for all items on our 'Website' is inclusive of sales tax (VAT) at the current rate. For shipments to non-European Union (EU) countries, sales tax will be deducted at checkout.
2. The goods offered at our 'Website' are presented in the format of digital photographs of the actual products. Minor discrepancies between the presentation and the actual products do not qualify as a defect in the goods ordered.
3. If you have ordered several items at the same time, the products may be delivered at different times. Shipping charges will be incurred only once in any such case.
§ 7 Delivery and Dispatch
We deliver your purchases worldwide by DHL, DHL EXPRESS, UPS or any other postal/parcel service, depending on the final destination. Once your parcel has been handed over to one of our logistics partners, you will receive your order's tracking number along with the delivery confirmation via email. This will allow you to check the status of your delivery online using the courier's tracking portal.
§ 7.1 Estimated Shipping Costs & Delivery Times
All merchandise in stock will be ready for dispatch one business day after the receipt of payment. For pre-orders the estimated shipping date will be displayed on the product details page and the confirmation order which is sent by email at the time of ordering.
Standard shipping is complimentary on all orders.

§ 7.2 Duties & Taxes
Deliveries to all European Union member states are on a DDP (delivery duty paid) basis. This means all import duties and local sales taxes are calculated and included within the purchase price.
Deliveries to all non-European Union countries are on a DDU basis (delivery duty unpaid). This means you will be liable for all import duties, customs and local sales taxes, levied by the country you are shipping to. As we are unable to advise the amount this may be, we suggest you contact your local customs office or DHL-office for further information.
The local sales tax (VAT) included in the final purchase price is automatically deducted at checkout for deliveries to all non-European Union countries.

The goods delivered remain the property of Christian Karch until full payment has been received.

§ 11 Warranty
Claims based on defects in the delivered goods shall be governed by the applicable legal provisions.
§ 11.1 Guarantee Conditions for ATELIER watches
Every ATELIER watch is warranted for a period of twelve (12) months. It covers material and manufacturing defects existing at the time of delivery. During the warranty period you will have the right to have any defect repaired free of charge. This includes the repair or replacement of any spare parts and/or rectifying any faults as identified by our Customer Service. In the event that repairs are unable to restore the normal conditions of use of your ATELIER watch, we guarantee its replacement by an ATELIER watch of identical or similar characteristics. The warranty does not cover normal wear and tear or damage caused by accidents or negligence.
§ 12 Governing law, severability
All legal disputes arising out of or in connection with a purchase contract shall be governed exclusively by German law to the exclusion of the UN Sales Convention.
If any provision is invalid, nothing in this shall prejudice the validity of the remaining provisions hereof.
